Website Terms & Conditions

1. The Free Initial Build

We create your initial website at no cost and with no obligation. You are under no obligation to proceed unless you approve the website. If you decide not to proceed, you owe nothing and the draft website remains our property.

2. Approval and the Free Build

Nothing is payable until you approve the website. By approving the website, paying an invoice, or asking us to connect your domain or make the website live, you agree to these terms.

There is no charge for the website build. Our standard build price is $1,999 AUD, and the build is provided free of charge on the condition that you take the hosting & website care plan described in section 5. Your first monthly payment is charged on the day you approve the website, and never before. Prices are plus GST if applicable.

3. What's Included

The build includes a custom-designed website of up to 5 pages, copywriting, and registration of one domain name in your name. The ongoing plan includes hosting, SSL, domain management, reasonable content updates and edits, and direct support. Extra work outside the agreed scope — such as additional pages, major redesigns, branding, or advanced integrations — may be quoted separately.

4. Ownership

Your domain name is registered in your name from the outset and is yours at all times, as are your logo and any content you provided.

Ownership of the website transfers to you once you have made 6 monthly payments on the hosting & website care plan. From that point the website — its design, code and content as delivered — is yours outright, and you may move it, modify it or host it wherever you choose.

If you cancel the plan before 6 monthly payments have been made, ownership of the website does not transfer, because the build was provided free of charge on the basis of that plan. If you wish to keep the website in that situation, you may purchase it outright for $499 AUD plus GST if applicable, and we will provide your website files and reasonable assistance to move it to a host of your choice. If you choose not to purchase it, the website is taken offline; your domain name and your own content remain yours.

We retain ownership of our general-purpose tooling, templates and know-how used to build websites, but nothing that prevents you using, moving or modifying a website you own.

5. Hosting & Website Care

The hosting & website care plan is $99 AUD per month plus GST if applicable, billed in advance by automatic recurring payment, beginning on the day you approve the website. It covers hosting, SSL, domain management, reasonable content updates and edits, and direct support.

There is no minimum term. You may cancel at any time, and cancellation takes effect at the end of the current paid billing period. Cancelling before 6 monthly payments have been made affects ownership of the website as set out in section 4. On cancellation we will provide reasonable assistance to transfer your domain to a host of your choice. We may change the monthly price by giving at least 30 days’ notice.

6. Failed Payments

If a payment fails, we may keep the website live for up to 7 days to allow you to update your payment method. After that, we may suspend hosting until payment is resolved. Suspension of hosting does not affect your ownership of your domain, and does not by itself change the ownership position described in section 4.

7. Your Content

You promise that you own, or have permission to use, any text, images, logos, trademarks or other content you give us for the website.

8. Service Availability

We aim to keep the website available and operating properly, but we do not guarantee uninterrupted or error-free service.

9. Liability

To the maximum extent permitted by law, we are not liable for any indirect or consequential loss, loss of profit, loss of revenue, loss of business opportunity, or loss of data arising from the use of the website or any service interruption.

Our total liability for any claim relating to the service is limited to the total fees paid by you in the 3 months before the event giving rise to the claim.

Nothing in these terms excludes any rights or guarantees that cannot lawfully be excluded under Australian law.

10. Privacy

If we collect personal information from you, we will handle it in accordance with our Privacy Policy.

11. Governing Law

These terms are governed by the laws of Queensland, Australia.
